dc.description.abstractPředkládaná práce pojednává o procesních břemenech v civilním řízení sporném. Procesní břemena nejsou právním řádem výslovně upravena a jedná se tak o instrumenty práva nepsaného, formulované právní teorií. Jakkoliv tedy může existovat neomezené množství procesních břemen, současná procesualistika rozeznává tři procesní břemena - břemeno tvrzení, břemeno důkazní a břemeno substancování. Předkládaná práce se zabývá jak vnitřní diferenciací vyjmenovaných procesních břemen, tak i jejich vzájemným vztahem, jakož i jejich vztahy s dalšími procesními jevy, jako jsou procesní povinnosti, koncentrace řízení, poučovací povinnost soudu.cs
dc.description.abstract-translatedThe presented work deals with procedural burdens in disputed civil proceedings. Procedural burdens are not explicitly regulated by the legal system and are thus instruments of unwritten law, formulated by legal theory. Thus, although there may be an unlimited number of procedural burdens, current proceduralism distinguishes three procedural burdens - the burden of assertion, the burden of proof, and the burden of substantiation. The presented work deals with both the internal differentiation of the listed procedural burdens, as well as their mutual relationship and their relations with other procedural phenomena, such as procedural obligations, concentration of proceedings, the duty of instruction of the court.en
