dc.description.abstractTato diplomová práce pojednává o institutu nutné obrany v trestním právu, jako o jedné z nejdůležitějších okolností vylučující protiprávnost. Nutná obrana je právní nástroj, pomocí kterého lze aktivně vystoupit proti bezprostředně hrozícímu či trvajícímu útoku na zájem chráněný trestním zákonem. Práce popisuje právně-historický vývoj nutné obrany v české trestněprávní teorii i praxi. Dále pojednává o ostatních okolnostech vylučujících protiprávnost. Těžiště práce ale spočívá v rozboru současné právní úpravy dané problematiky a v neposlední řadě je institut nutné obrany v českém trestním zákoníku podroben komparaci s vybranými právními úpravami sousedních zemí. Konec práce obsahuje dva zajímavé exkursy o netypických případech nutné obrany a to, pojednání o automatických obranných systémech a dále stručných rozbor nutné obrany v občanském zákoníku.cs
dc.description.abstract-translatedThis diploma thesis discusses the necessary defense in terms of criminal law which is one of the most important types of circumstances excluding illegality. Necessary defense is a legal instrument by which one can actively oppose the continuing or imminent attack on the interests protected by criminal law. This thesis describes the development of a necessary defense in the Czech criminal law of the theory and practice. The first part sets out other circumstances excluding illegality, focusing on the current legislation of this issue and finally compares the Czech legal rights law with some neighboring states. The end of this work also contains the two selected areas of the interesting issues: an automatic defense systems and the concept of necessary defense in the Civil Code.en
