dc.description.abstractHlavním cílem této diplomové práce je vytvoření komplexního přehledu o věcných břemenech, resp. věcných břemen s veřejnoprávním prvkem. Práce vychází z historického vývoje právní úpravy na území ČR, ale také se zmiňuje o vývoji věcných břemen ve starověkém Římě, jenž je hlavním zdrojem inspirace pro právní úpravu jako takovou. V další části se práce soustředí na popis funkce věcných břemen, dále na jejich vznik, zánik a ostatní důležité aspekty z této oblasti. Další sekce této práce popisuje jednotlivá odvětví, v kterých věcná břemena s veřejnoprávním prvkem sehrávají důležitou roli. Nezbytnou částí je porovnání věcných břemen v českém právním systému s věcnými břemeny v anglickém common law. Poslední fáze této teze je věnována současné právní úpravě a návrhům de lege ferenda.cs
dc.description.abstract-translatedThe main goal of this diploma thesis is to create comprehensive overview of easements, respectively easements with public law element. The thesis is based on the historical development of legislation on the territory of Czech republic but it also mentions the development of easements in ancient Rome as the main source of inspiration for legislation as a whole. In the next part, the thesis focuses on the description of function of easements, then on their creation, termination and other important aspects of this area. Next section of this work describes individual sectors in which the easements with public law element play an important role. Necessary part of the thesis is comparison of easements in Czech legal system with easements in English common law. The final part of this thesis is dedicated to current legislation and speaks about de lege ferenda proposals.en
