| dc.description.abstract | Tato diplomová práce je zaměřena na téma whistleblowingu a ochrany oznamovatele. Práce popisuje historický kontext pojmu whistleblowing a jeho vnímání v průběhu vybraných historických mezníků a právních kultur. Dále jsou představeny i některé případy nejznámějších whistleblowerů, které byly mediálně známé především ve 20. století ve Spojených státech amerických. Diplomová práce dále popisuje relevantní judikaturu Evropského soudu pro lidská práva, která shrnuje základní principy ochrany oznamovatelů. Ty dále přejímá i evropská úprava především pak směrnice Evropského parlamentu a Rady (EU) 2019/1937 ze dne 23. října 2019 o ochraně osob, které oznamují porušení práva Unie, které se tato diplomová práce rovněž věnuje. Dále jsou popsány návrhy zákonů, které byly v České republice předloženy před i po přijetí směrnice. V poslední řadě diplomová práce popisuje v nedávné době přijatý zákon č. 171/2023 Sb., o ochraně oznamovatelů, popisuje jeho hlavní aspekty a vyjadřuje se k některým z jeho problematických aspektů. | cs |
| dc.description.abstract-translated | This diploma thesis focuses on the topic of whistleblowing and whistleblower protection. The thesis describes the historical context of the concept of whistleblowing and its perception across selected historical landmarks and legal cultures. In addition, some of the most famous whistleblower cases are also presented, which have received media coverage, particularly in the 20th century in the United States. The thesis also describes the relevant case law of the European Court of Human Rights, which summarizes the basic principles of whistleblower protection. These are further adopted by European legislation, in particular Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of whistleblowers, which is also the focus of this thesis. In addition, the draft laws that were introduced in the Czech Republic before and after the adoption of the Directive are described. Lastly, the thesis describes the recently adopted Act No. 171/2023 on the protection of whistleblowers, describing its main aspects and commenting on some of its problematic aspects. | en |
