Nejen k pracovnímu poměru na dobu určitou z hlediska novely zákoníku práce

Abstract

Příspěvek je zaměřen na právní úpravu pracovních poměrů na dobu určitou. Autor kriticky hodnotí současnou rozhodovací praxi vysokých soudů (Nejvyšší soud a Ústavní soud). Kromě toho autor uvádí své úvahy de lege ferenda. Dále je příspěvek zaměřen na vybrané body návrhu aktuální novely zákoníku práce. Konkrétně se zaměřuje na návrh změny právní úpravy zkušební doby, výpovědní doby či doručování písemností zaměstnanci do vlastních rukou.

The paper is focused on the legal regulation of fixed-term employment. The author critically evaluates the current decision-making practice of high courts (The Supreme Court and the Constitutional Court). In addition, the author presents his considerations de lege ferenda. Furthermore, the paper is focused to selected points of the draft of the current amendment to the Labour Code. Specifically, it focuses on the proposal to change the legal regulation of the probationary period, the notice period or the delivery of documents to the employee in his own hands.
