dc.description.abstractTato diplomová práce pojednává o institutu dohoda o vině a trestu, který byl do českého právního řádu inkorporován novelou trestního řádu č. 193/2012 Sb., s účinností od 1. 9. 2012. V samotném úvodu práce je obsažena charakteristika odklonů obecně, včetně popisu jednotlivých vybraných forem odklonu. Dále diplomová práce obsahuje výklad a popis dohody o vině a trestu, společně se zhodnocením současné právní úpravy. Autorka následně zhodnocuje (ne)využitelnost dohody o vině a trestu. Diplomová práce rovněž předkládá popis institutu dohody o vině a trestu ve Slovenské republice, dále autorka komparuje českou právní úpravu institutu dohody o vině a trestu s právní úpravou slovenskou. Závěrem práce se autorka zamýšlí nad možnostmi dalšího vývoje de lege ferenda dohody o vině a trestu.cs
dc.description.abstract-translatedThis diploma thesis deals with the institute agreement on guilt and punishment, which was incorporated into the Czech law by the amendment of the Criminal Procedure Code No. 193/2012 Coll. The introduction of the thesis contains the characteristics of diversions in general, including description of the selected diversion forms. Furthermore, the thesis contains an interpretation and description of the agreement on guilt and punishment, together with an assessment of the current legislation. The author then evaluates (un) the applicability of the guilt and punishment agreement. The thesis also presents a description of the institute of the agreement on guilt and punishment in the Slovak Republic, the author further compares the Czech legal regulation of the institute of the agreement on guilt and punishment with the Slovak legislation. At the end of the work the author considers the possibilities of further development de lege ferenda agreement on guilt and punishment.en
