dc.description.abstractDiplomová práce se zabývá problematikou výslechu svědka v civilním soudním řízení, který patří mezi nejvýznamnější důkazní prostředky. Smyslem této diplomové práce je především popsat proces výslechu svědka, a to od okamžiku předvolání k jednání až po konečné zhodnocení jeho věrohodnosti. Cílem práce je systematicky zmapovat celý tento proces, jakož i upozornit na možné odlišnosti v jeho provedení dané specifiky na straně soudu či osobou svědka. Práce je systematicky členěna do 4 hlavních kapitol, nechybí ani úvod a závěr. V první kapitole je věnován prostor krátkému historickému vývoji tohoto důkazního prostředku. Kapitola druhá rozebírá klíčové pojmy, jakož se i podrobně věnuje průběhu výslechu svědka. Třetí kapitola je zaměřena na proces určení a zhodnocení věrohodnosti svědka. Poslední kapitola popisuje specifické situace, na základě kterých je realizován výslech svědka odlišně od jeho standartní provedení.cs
dc.description.abstract-translatedThe thesis deals with the issue of witness interrogation in civil court proceedings, which is one of the most important means of evidence. The main purpose of this thesis is to describe the process of interrogating a witness, from the moment of summoning him up to the final assessment of his credibility. The aim of the thesis is to systematically map the whole process, as well as to point out possible differences in its implementation due to the specifics given by the court or the person of the witness. The thesis is systematically divided into 4 main chapters, including an introduction and a conclusion. In the first chapter, space is devoted to a brief historical development of this means of evidence. Chapter two discusses the key concepts as well as discusses in detail the process of questioning a witness. Chapter three focuses on the process of determining and assessing the credibility of a witness. The last chapter describes the specific situations that make witness examination different from the standard execution.en
