| dc.description.abstract | Diplomová práce na téma "Postih manželských majetkových práv v exekučním řízení" shrnuje základní problematiku týkající se možnosti zásahu do společného jmění manželů v rámci exekučního řízení. Jedná se o velmi důležité téma, neboť se dotýká úpravy manželských majetkových práv jako takových, především pak výkonu rozhodnutí formou soudní exekuce. Práce je rozdělena do 5 kapitol, z nichž první úvodní kapitola přináší informace o záměrech práce, které by měly být naplněny. Druhá kapitola přináší pohled na manželské majetkové právo jako takové v souvislosti s historickým vývojem z bezpodílového společenství manželů k institutu společného jmění manželů. Tato kapitola usnadní chápaní procesní části problému a slouží jako podklad pro uplatnění procesní úpravy. Stěžejní část práce se nachází ve třetí kapitole, která se zabývá dvojkolejností právní úpravy v exekučním řízení, dále pak účastenstvím manželů, ke kterému se váží účinky doručení vyrozumění o zahájení exekučního řízení. V práci je kladen důraz na problematiku dluhů jednoho z manželů v rámci kterých se oprávněný může uspokojit z toho, co náleží do společného jmění manželů. S tímto souvisí omezení v rámci kterých se musí exekutor při výkonu rozhodnutí pohybovat. Důraz je kladem především na časté novelizace, které přináší řadu problémů. Předposlední část práce se věnuje právní úpravě na Slovensku a porovnání některých částí exekučního řízení vzhledem k naší společné historii. V poslední kapitole je shrnutí poznatků, relevantních tomuto tématu společně s úvahou de lege ferenda. | cs |
| dc.description.abstract-translated | The theme of the master thesis is "Sanction of the spousal property law during the execution proceedings. It summarizes the basic problematics related to the possibility of intervening into the common property of spouses in terms of an execution proceeding.This area is very important because it concerns the adjustments of the spousal property laws as such, especially the execution of the decision in the form of the judicial execution. The thesis is divided into 5 chapters. The first introduction chapter brings information about the intentions of the thesis and the aims which should be achieved. The second chapter brings a point of view to the spousal property law as such in connection with the historical development from the joint tenants to the common spousal property. This chapter will facilitate the understanding of the processional part of the problem and serves as a base for implementing the processional adjustments. The crucial part of the thesis is the third chapter which deals with the double-sidedness of the judicial adjustment in the execution proceeding; and with the participation of the spouses, which is connected to the effects of delivering the notification informing about the execution proceeding. The emphasis is put on the problematics of debts of one of the spouses, where the legitimate may be satisfied by the common spousal property. This is connected to the restrictions that must be respected by the executor during the execution process. The emphasis is put especially on the frequent novelizations, which bring a lot of difficulties. The penultimate part of the thesis focuses on the judicial amendment in Slovakia and the comparison of some parts of the execution proceeding in our common history. Last chapter summarizes the findings, relevant to this topic together with consideration de lege ferenda. | en |
