dc.description.abstractVýpověď z nájmu bytu ze strany nájemce upravuje § 2287 a ze strany pronajímatele § 2288 a 2291 zák. č. 89/2012 Sb.. Nájemce je zákonem chráněn jako slabší strana vztahu a nemá striktně zákonem vymezené výpovědní důvody. Výpovědní doba je tříměsíční. Pronajímateli umožňuje zákon vypovědět nájem okamžitě nebo s výpovědní dobou tři měsíce, přičemž určuje důvody, za kterých lze obě varianty provést. Mezi zákonnými důvody a výpovědní dobou existuje nepoměr, kdy např. v případě úmyslného trestného činnu nemůže pronajímatel vypovědět nájem bez výpovědní doby, ale pouze s výpovědní dobou tři měsíce.cs
dc.description.abstract-translatedThe termination of the lease of an apartment by the tenant is stated in section 2287of Act No. 89/2012 Coll., on Civil Code, as amended and the termination of the lease of an apartment by the lessor is stated in section 2288of Act No. 89/2012 Coll., on Civil Code, as amended. The tenant is protected by the law as a weaker party and his reasons for the notice are not strictly stated in the Civil Code. The notice period is three months. The lessor is allowed to terminate the lease immediately or with the notice period of three months, while the reasons of the termination are stated in the Civil Code. Between the statutory reasons and the notice period is disproportion, for example in case of the intentional criminal act the lessor is not allowed to terminate the lease immediately, but only with the notice period of the three months.en
