| dc.description.abstract | Diplomová práce se věnuje právní úpravě evidence skutečných majitelů, způsoby, jakými se skuteční majitelé určují a také právní úpravě oblasti opatření proti praní špinavých peněz a financování terorismu (dále jen "AML"). V oblasti AML se jedná zejména o implementaci jednotlivých směrnic Evropské unie (tzv. čtvrté a páté AML směrnice) do právního řádu České republiky. Z příslušných zákonů, do kterých byla právní úprava Evropské unie implementována, vychází pravidla pro evidování skutečných majitelů. Cílem diplomové práce je podrobně zanalyzovat jednotlivé právní předpisy a související dokumenty v oblasti evidování skutečných majitelů, stejně tak jako vývoj právní úpravy na území České republiky nebo provést analýzu právní úpravy v dalších státech Evropské unie. Diplomová práce si klade za cíl zanalyzovat způsoby, jakým se určuje skutečný majitel. V rámci diplomové práce je následně nutno takto zanalyzované informace podrobit kritickému zhodnocení. | cs |
| dc.description.abstract-translated | The thesis focuses on the legal regulation of the registration of beneficial owners, the ways in which beneficial owners are determined and the legal regulation of measures against money laundering and terrorist financing (hereinafter referred to as "AML"). In the area of AML, it is mainly about the implementation of individual EU directives (the so-called fourth and fifth AML directives) into the legal system of the Czech Republic. The rules for the registration of beneficial owners are based on the relevant laws into which the EU legislation has been implemented. The aim of the thesis is to analyse in detail the individual legal regulations and related documents in the field of beneficial ownership registration, as well as the development of the legislation in the Czech Republic or to analyse the legislation in other EU countries. The thesis aims to analyse the ways in which the beneficial owner is determined. In the framework of the thesis, the information thus analysed must be subjected to a critical evaluation. | en |
