dc.description.abstractTato diplomová práce se zaměřuje na právní institut smluvního zastoupení, jeho definici, historii a praktické využití v právní praxi. Podrobně rozebírá různé formy smluvního zastoupení, včetně plné moci, obchodního zastoupení, příkazní smlouvy a zprostředkování. Dále se věnuje právním předpisům týkajícím se vzniku a zániku smluvního zastoupení, formám zmocnění a právním důsledkům. Práce také porovnává českou úpravu smluvního zastoupení s právními systémy Německa, Rakouska a Francie a zohledňuje nové výzvy, které přináší digitální éra, jako jsou elektronické plné moci a technologie eID. Cílem práce je poskytnout komplexní přehled o smluvním zastoupení a jeho významu v současném právním prostředí.cs
dc.description.abstract-translatedThis thesis focuses on the legal institute of contractual representation, its definition, history, and practical application in legal practice. It thoroughly analyzes various forms of contractual representation, including powers of attorney, commercial representation, mandate agreements, and mediation. The thesis also addresses the legal regulations concerning the formation and termination of contractual representation, the forms of empowerment, and their legal consequences. Additionally, it compares the Czech regulation of contractual representation with the legal systems of Germany, Austria, and France and considers new challenges brought by the digital era, such as electronic powers of attorney and eID technologies. The goal of this thesis is to provide a comprehensive overview of contractual representation and its significance in the current legal environment.en
