dc.description.abstractDiplomová práce pojednává o vzájemných právech a povinnostech advokáta a klienta daných českou právní úpravou. Práce popisuje historický vývoj práv a povinností na území České republiky. Dále se věnuje úpravě většiny práv a povinností v právním vztahu advokáta a klienta, která vyplývají nejen ze zákonů, ale i ze stavovských předpisů. Práce také srovnává českou právní úpravu práv a povinností s etickým kodexem pro advokáty Evropské unie a vybranými ustanoveními některých evropských zemí. V rámci zahraniční komparace analyzuje americkou právní úpravu práv a povinností obsaženou v Model Rules of Professional Conduct. V poslední kapitole se pak zabývá možným porušením povinností jak na straně advokáta, tak i na straně klienta.cs
dc.description.abstract-translatedThe thesis deals with the relative rights and obligations between a lawyer and a client, which are established by the Czech legislation. The thesis describes historical development of the rights and obligations in the area of the Czech Republic. The thesis is also focused on the majority of rights and obligations in a legal relationship between a lawyer and a client, which results from the legal regulations and from the professional rules. The thesis also compares Czech legislation of the relative rights and obligations with the Code of Conduct for the Lawyers in the European Union and selected provisions from certain European countries. In terms of international comparison the thesis analyzes US legislation of the rights and obligations in the Model Rules of Professional Conduct. The last chapter of the thesis is focused on the possible infringement of the obligations by the lawyer and also by the client.en
