"Pornografické trestné činy" z pohledu judikatury Nejvyššího soudu ČR

Abstract

Příspěvek je věnován tématu, které je v oblasti zvláštní části trestního práva stále aktuální, a sice problematice tzv. „pornografických trestných činů“. Pornografické trestné činy jsou specifickou subskupinou trestných činů proti lidské důstojnosti v sexuální oblasti, které vzhledem ke svým chráněným objektům působí vysoce společensky škodlivě. Cílem příspěvku je tak poskytnout rozbor jednotlivých ustanovení trestního zákoníku, která se problematice pornografických trestných činů věnují. Rozbor je zaměřen zejména na souvislosti s judikaturou Nejvyššího a Ústavního soudu ČR, neboť jednotlivá rozhodnutí v konkrétních věcech dokreslují, někdy místy ne příliš jasnou zákonnou úpravu. Krátký exkurz do problematiky bude poskytnut rovněž prostřednictvím kriminologického pohledu na pornografii a pornografické trestné činy.

The paper is dedicated to a topic that is still topical in the area of a special part of criminal law, namely the so-called issue. "pornographic offences". Pornographic offences are a specific sub-group of crimes against human dignity in the sexual field which are highly socially harmful in relation to their protected objects. The aim of the contribution is thus to provide an analysis of the individual provisions of the Criminal Code that deal with the issue of pornographic crimes. The analysis focuses mainly on the context with the jurisprudence of the Supreme and Constitutional Courts of the Czech Republic, as individual decisions in specific cases illustrate, sometimes in places, not very clear legal regulations. A short field trip into the issue will also be provided through a criminology look at pornography and pornography offences.
