| dc.description.abstract-translated | This presentation analyses the development of the office of Lord Chancellor in England, reflecting changes in the legal and political order. Originally an essential figure in the legal system, adjudicating where the common law failed, he was instrumental in the development of a body of legal principles known as equity. However, the Lord Chancellor’s decision-making gradually became almost just as rigid and formalistic as the common law itself, resulting in a crisis of the chancery system in the 19th century, which led to the merger of the jurisdictions of the Chancery Courts and the Common-law Courts. Today, the Lord Chancellor’s role has changed significantly and he no longer holds a judicial position in any sense. The Lord Chancellor is primarily the Secretary of State for Justice and holds a number of other administrative and ceremonial positions. However, questions still arise today about the possible politicisation of the Lord Chancellor’s office and the potential abuse of the office for political ends, which could undermine the independence of the judiciary and common trust in the legal system. | en |
