| dc.description.abstract | Tato diplomová práce se zabývá následky neplatného rozvázání pracovního poměru. Práce se zaměřuje na zhodnocení právní úpravy zákoníku práce a související judikatury, právního jednání vedoucího k rozvázání pracovního poměru a vymezení nástroje ochrany před neplatným rozvázáním pracovního poměru. Diplomová práce se skládá ze sedmi kapitol Nejprve bude vymezena základní charakteristika pracovního práva jako samostatného právního odvětví a několik vybraných základních zásad spojených s pracovním právem. Další kapitola rozebírá způsoby neplatného rozvázání pracovního poměru. Poslední tři kapitoly analyzují příčiny neplatného rozvázání pracovního poměru v rozhodovací praxi soudů, právní rámec a judikaturu neplatného rozvázání pracovního poměru a souvisejících nároků zaměstnance a zaměstnavatele, stejně jako specifika žaloby o určení neplatnosti rozvázání pracovního poměru. | cs |
| dc.description.abstract-translated | This diploma thesis concerns void termination of an employment relationship and its consequences. The thesis focus on evaluation of the legal regulation of the Czech Labour Code and the related case law, legal acts leading to termination of employment relationship and defining of legal instruments as a protective measures against void termination of employment relationship and consequences of void termination of employment relationship. The diploma thesis consists of seven chapters. Firstly the thesis will define labour law as an independent part of the are of laws, and few selected basic principles connected to czech labour law. Next part of the thesis describes acts which leads to termination of employment relationship. The last three chapters analyse the causes of the void termination of employment in the Czech case law , the legal framework and the case law of the void termination of employment and of the related claims of the employee and the employer, just as the specifics of the legal action for annulment of the termination of employment | en |
