| dc.description.abstract | Diplomová práce se věnuje institutu retenčního, neboli zadržovacího, práva jakožto věcněprávního zajišťovacího institutu, jehož účelem je zajištění pohledávky. Cílem diplomové práce je souhrnný popis platné právní úpravy zadržovacího práva, zejména obsažené v zákoně č. 89/2012 Sb., občanský zákoník. Práce nejprve poskytuje vhled do vývoje právní úpravy zadržovacího práva. Poté již přibližuje jednotlivé aspekty zadržovacího práva, jeho účel, osobu zadržitele, předmět zadržovacího práva, jeho vznik, výkon, včetně souvisejících práv a povinností, také se věnuje promlčení a zániku zadržovacího práva. Dále se práce věnuje výkonu zadržovacího práva v konkrétních právních vztazích upravených občanským zákoníkem. V neposlední řadě práce přináší srovnání zadržovacího práva se zástavním. Práce si všímá výkladových nesrovnalostí, které porovnává s platnou právní úpravou a ustálenou judikaturou. Každý aspekt zadržovacího práva je popisován v širších souvislostech, kdy právní úprava zadržovacího práva přesahuje například do insolvenčního řízení a civilního řízení. Práce neopomíjí ani ústavněprávní a trestněprávní rovinu zadržovacího práva. | cs |
| dc.description.abstract-translated | This thesis deals with the right of retention, also called as the lien, which is a pledge of a debt. The aim of the thesis is to summarize the effective legislation of the lien, especially included the Act no. 89/2012 Coll., Civil Code. First of all, the thesis provides an insight into development of the legislation of the lien, including the antecedent legislation of the lien. Subsequently, the thesis deals with individual aspects aspect of the lien, such as functions of the lien, the lienor, the object of the lien, the creation and the extinguishment of the lien, and the exercise of rights and the discharge of duties in connection with the lien. Furthermore, the thesis expounds the exercise of the right of retention within particular legal obligations that are included in Civil Code. Last but not least, the thesis compares the right of retention to the security interest. The thesis also focuses on a disunited interpretation of the effective legislation of the lien, which the thesis compares to the effective legislation of the lien and established practice of the courts. Moreover, the thesis describes the aspects of the right of retention in a broader context, for example the right of retention overlaps with a part of insolvency and civil proceedings. The thesis also takes notice of the constitutional and criminal aspect of the lien. | en |
