dc.description.abstractTato diplomová práce pojednává o řízení ve věcech dětí mladších patnácti let upravené v hlavě třetí zákona č. 218/2003 Sb. Jedná se o specifický typ řízení, které byť je reakcí na spáchaný čin, jež by jinak byl trestným činem, není řízením trestním a není v něm postupováno podle trestního řádu. Z toho důvodu budou ve stěžejní části této práce řešeny zásadní otázky vztahující se k tomuto typu řízení, odlišnosti od trestního řízení a s tím související odlišnosti v postavení trestně neodpovědných dětí mladších patnácti let. Bude popsán i samotný průběh jednání před soudem pro mládež. Poslední kapitola bude věnována opatřením, jež mohou být dětem mladším patnácti let za spáchaný čin jinak trestný uložena. Byť je práce zaměřena spíše na procesní stránku dané problematiky, nelze odhlédnout od hmotněprávních aspektů, resp. od rozumové a mravní vyspělosti mladých jedinců a od toho odvíjející se určování věkové hranice trestní odpovědnosti. Na úvod práce proto bude pojednáno o trestní odpovědnosti fyzických osob se zaměřením na věkovou hranici trestní odpovědnosti.cs
dc.description.abstract-translatedThe diploma thesis concerns the proceeding in the matters of children under the age of fifteen which is provided in the Act No. 218/2003 Coll. The proceedings in the matters of children under the age of fifteen are not the criminal proceedings in spite of the fact they react on the offences indentified by Criminal Code (acts otherwise criminal). In the core part of the thesis, the hearing with the child who is not criminally liable is described relating to acts regulating the civil proceedings and also the problematic questions are solved. The last chapter is focused on the measures which could be impose as reaction on the act otherwise criminal. First of all, the thesis deals with the age of criminal responsibility regarding to intellectual and moral maturity because a low age and developmental specifics must be taken into account also in proceedings in the matters of children.en
