dc.description.abstractDiplomová práce "Konkurence trestných činů" pojednává o problematice souběhu trestných činů. Je odlišen souběh od recidivy, nastíněn stručný historický vývoj institutu souběhu, rozebrán pojem skutku a jednoty skutku. Dále je popsán a rozlišen souběh jednočinný a souběh vícečinný. Práce také popisuje, kdy se o souběh jednat nemůže, tedy případy vyloučení souběhu. Následně se zaměřuje na účinky souběhu hmotněprávní a procesněprávní, poté na ukládání trestu za souběh a zásady jeho trestání. Nakonec je zhodnocena úprava de lege lata a poskytnuty návrhy de lege ferenda.cs
dc.description.abstract-translatedThe main aim of the theses is to explain term "Concurrence of the crimes". Thesis deals with the issues of concurrence and distinguishes this term from the recurrence, then briefly describes development of the term of concurrence, then term of deed and unity of the deed is explained with distinguishing the separate types of concurrence like homogenous concurrence and heterogenous concurrence. Thesis also explains situations where concurrence cannot occur exclusion of the concurrence and focuses on impact which concurrence has in the substantive and procedural law and principles of punishment. Finally is evaluated regulation de lege lata and provided suggestions de lege ferenda.en
