dc.description.abstractPráce je zaměřena na reflexi vývoje a současné podoby právní úpravy vztahů osob stejného pohlaví v České republice. Na úvod je věnována pozornost neformální kohabitaci, právům a povinnostem spolužijících osob a odlišnostem od kohabitace párů osob opačného pohlaví. Následně je analyzováno registrované partnerství přijaté na základě zák. č. 115/2006 Sb. Poté jsou reflektovány soudobé snahy o redefinici manželství tak, aby bylo otevřeno i párům osob stejného pohlaví, jejímž výsledkem bylo přijetí nového institutu partnerství dle občanského zákoníku, jež vstoupil v účinnost 1. 1. 2025. Nový institut je rovněž v obecných rysech analyzován a jsou nastíněny i jeho případné problematické aspekty. Na vhodných místech je provedena komparace se zahraničními úpravami obdobných institutů v jiných státech (např. PACS ve Francii). Rovněž je pro ucelený pohled jako exkurz doplněno pozadí snahy o redefinici manželství v letech 2018-2021, jakož i dílčí návrhy, jež měly rovněž upravit práva a povinnosti párů osob stejného pohlaví.cs
dc.description.abstract-translatedThe rigorous thesis focuses on the reflection of the development and current form of legal regulation of same-sex relationships in the Czech Republic. At the beginning, attention is paid to informal cohabitation, rights and obligations of cohabitees and differences from cohabitation of opposite-sex couples. Afterwards, the registered partnership adopted on the basis of Act No. 115/2006 Coll. is analysed. Afterwards, contemporary efforts to redefine marriage so that it is open to same-sex couples are reflected, which resulted in the adoption of the new institution of partnership under the Civil Code, which came into force on 1 January 2025. The new institution is also analysed in general terms along with possible problematic aspects. At appropriate places, a comparison is made with foreign regulations of similar institutes in other countries (e.g. PACS in France). The background of the efforts to redefine marriage in the years 2018 to 2021 is also added as an excursus for a comprehensive view, as well as partial proposals that were also intended to regulate the rights and obligations of same-sex couples.en
