| dc.description.abstract | Diplomová práce pojednává o procesním institutu určovací žaloby. V první část práce je zaměřena na samotnou obecnou žalobou, vymezí její náležitosti, význam a rozebrání vztahu mezi žalobou a tvrzeným nárokem. V poslední řadě dalším druhům žalob vedle žaloby určovací. Další část práce věnována výhradně určovací žalobě. Určovací žaloba je zasazena do historického kontextu a poté teoreticky, s případnými odkazy na judikaturu dále řešena. Dále pak následuje vymezení vztahu mezi určovací žalobou a žalobou na plnění. Následuje význam naléhavého zájmu na určovací žalobě. V poslední řadě se práce zaobírá určovacími žalobami upravenými zvláštními zákony. Poslední část práce je věnována komparaci se zahraniční právní úpravou tohoto procesního institutu. | cs |
| dc.description.abstract-translated | The diploma thesis deals with the procedural institute of a declaratory action. The first part of the thesis focuses on the general action itself, defining its elements, meaning and discussing the relationship between the action and the alleged claim. Lastly, other types of actions besides the claim for determination. The next part of the thesis is devoted exclusively to the declaratory action. The action for determination is set in a historical context and then discussed theoretically, with possible references to case law. This is followed by a definition of the relationship between an action for declaratory relief and an action for performance. The significance of the overriding interest in an action for declaratory relief is then discussed. Lastly, the thesis deals with actions for determination governed by special laws. The last part of the thesis is devoted to a comparison with the foreign legal regulation of this procedural institute. | en |
