Dopad legislativy EU na práva obětí trestných činů v České republice

Abstract

Článek se zabývá dopadem a přínosem legislativních předpisů Evropské unie na práva obětí trestných činů a jejich postavení v trestním řízení. Článek zkoumá zejména implementaci směrnice Evropského parlamentu a Rady 2012/29/EU ze dne 25. října 2012, kterou se zavádí minimální pravidla pro práva, podporu a ochranu obětí trestného činu a kterou se nahrazuje rámcové rozhodnutí Rady 2001/220/SVV do českého právního řádu prostřednictvím zákona č. 45/2013 Sb., o obětech trestných činů. V této souvislosti článek mapuje vývoj právního postavení obětí trestných činů v České republice a peněžité pomoci pro oběti trestných činů. Rovněž optikou hodnot a zásad Evropské unie a hodnotí jejich efektivitu zejména v praxi a posoudí, zda Česká republika dosáhla požadované úrovně ochrany obětí trestných činů a jejich peněžité pomoci vyplývající z postoje Evropské unie, resp. uvedené směrnice. Na závěr článek přinese úvahy, jakým směrem by se mohla ochrana obětí trestných činů vyvíjet a představí další chystané kroky v rámci EU, které by se měly dotýkat práv obětí trestných činů.

The article deals with the impact and contribution of EU legislation on the rights of victims of crime and their position in criminal proceedings. In particular,the article examines the implementation of Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012, establishing minimum standards on the rights, support and protection of victims of crime, and replacing Council Framework Decision 2001/220/JHA, into the Czech legal system through Act No. 45/2013 Coll., on victims of crime. In this context, the article charts the development of the legal status of victims of crime in the Czech Republic and of financial assistance for victims of crime. It also uses the lens of the values and principles of the European Union and assesses their effectiveness, particularly in practice, and assesses whether the Czech Republic has achieved the required level of protection of victims of crime and their financial assistance resulting from the position of the European Union or the Directive. The article concludes with a reflection on how the protection of victimsof crime could evolve and presents further forthcoming steps within the EU that should affect the rights of victims of crime.
