dc.description.abstractHlavním cílem diplomové práce je analýza trestněprávní odpovědnosti za porušení postupu lege artis v medicíně. Práce se zaměří na vymezení pojmu lex artis, jeho právní prameny a související judikaturu. Dále se bude zabývat problematikou trestněprávní odpovědnosti poskytovatelů zdravotních služeb a lékařů a v souvislosti s postupem non lege artis. Práce se bude věnovat i otázkám okolností vylučujících protiprávnost a specifické problematice trestní odpovědnosti právnických osob. V závěru práce budou zhodnoceny dopady pandemie COVID-19 na poskytování zdravotních služeb a trestněprávní odpovědnost. Práce bude zpracována metodou analýzy právních předpisů, judikatury a odborné literatury. V práci budou využity i fiktivní situace, které pomohou demonstrovat založení či vyloučení trestní odpovědnosti v medicíně.cs
dc.description.abstract-translatedThe main goal of the diploma thesis is to analyze the criminal consequences for breaching the lege artis procedure in medicine. The thesis will focus on the definition of the lex artis concept, its legal sources and related case law. Furthermore, it will deal with the issue of criminal liability of healthcare practitioners and providers due to breaches of set concept. The thesis will also address issues of the circumstances precluding illegality and the specific issue of the criminal liability of legal entities. Finally, the thesis will evaluate the impact of the COVID-19 pandemic on healthcare provision and criminal liability. The thesis will be processed using the method of analyzing legal regulations, case law and professional literature. Fictitive situations may also be used aswell in order to demonstrate the establishment or exclusion of criminal liability in medicine.en
