dc.description.abstractDiplomová práce podrobněji rozebírá problematiku vázanosti soudů jinými rozhodnutími. Úvodní část se zabývá rozlišením mezi vázaností soudů rozhodnutími a samotnou závazností rozhodnutí. Dále se zabývá závazností rozhodnutí Evropského soudu pro lidská práva a rozhodnutí Soudního dvora Evropské unie. Práce následně specifikuje jiná rozhodnutí, kterými je soud při svém rozhodování vázán a věnuje se i rozhodnutím Ústavního soudu České republiky a Nejvyššího soudu České republiky. Závěr práce se zabývá vázaností jednotlivých soudních rozhodnutí z hlediska hiearchie soudů. Práce zmiňuje i formy vázanosti a u každé kapitoly podrobněji rozebírá vybraná rozhodnutí pro lepší pochopení problematiky.cs
dc.description.abstract-translatedThe thesis examines in detail the issue of courts being bound by other decisions. The introductory part addresses the distinction between being bound by decisions and the binding nature of decisions themselves. It further discusses the binding nature of the decisions of the European Court of Human Rights and the decisions of the Court of Justice of the European Union. The thesis then specifies other decisions to which courts are bound in their decision-making process, also addressing decisions of the Constitutional Court of the Czech Republic and the Supreme Court of the Czech Republic. The conclusion focuses on the binding nature of individual judicial decisions in terms of the hierarchy of courts. The thesis also mentions the forms of binding and, in each chapter, thoroughly examines selected decisions for a better understanding of the issue.en
