dc.description.abstractTato diplomová práce se zabývá ochranou práv na označení v Evropské unii, se zaměřením na institut ochranné známky EU. Cílem práce je analyzovat právní rámec ochranných známek, proces jejich registrace a mechanismy vymáhání práv, které jsou dostupné jejich majitelům. Práce se opírá o unijní, mezinárodní a českou právní úpravu, včetně Nařízení EU 2017/1001 o ochranné známce Evropské unie a Směrnice EU 2015/2436 o sbližování právních předpisů členských států v oblasti ochranných známek. Zároveň zohledňuje klíčové mezinárodní smlouvy, jako je Pařížská úmluva, Dohoda TRIPS nebo Madridskou dohodu. Dále identifikuje klíčové výzvy, jako je přeshraniční vymáhání práv nebo fenomén trademark squattingu.cs
dc.description.abstract-translatedThis thesis examines the protection of designation rights in the European Union, focusing mainly on the institution of the EU trademark. The aim of the thesis is to analyse the legal framework of trademarks, the process of their registration and the enforcement mechanisms available to their owners. The work draws on EU and international legislation, including Regulation 2017/1001 on the European Union trade mark and Directive 2015/2436. It also takes into account key international treaties such as the Paris Convention, the TRIPS Agreement or the Madrid Agreement. Additionally, it highlights key challenges such as cross-border enforcement and trademark squatting.en
