Flexibility Versus Job Security – Employment Outside the Main Employment Relationship in the Czech Republic and Germany

dc.description.abstract-translatedThe article responds to recent legislative changes in the Czech Republic’s legal regulations regarding the employment of workers outside the main employment relationship and compares the new conditions of these agreements with specific forms of employment in Germany (specifically Minijob and Midijob). The aim of the article is to identify and quantify the differences between Czech and German legal regulations with regard to flexibility, social security, or employee protection and burden on employers. The primary methods include comparison (examining the burden on both employees and employers, from income levels up to a quarter of the average wage to those above a quarter of the average wage) and in-depth interviews with experts who have been involved in these types of employment for an extended period. The comparison shows that the German system of Minijobs and Midijobs offers a stable model with a smooth transition to higher contributions and the preservation of social benefits. Experts agree that the amendment to Czech legal regulations has expanded protection, but at the cost of losing the original attributes: simplicity, short-termity and lower administrative burden. The room for improvement is in addressing the administrative burden and the incremental burden of social security contributions, which can lead to artificially limiting employees’ incomes to stay below the limit, thereby maintaining higher net earnings and lower employer insurance burdens. Here, one can draw inspiration from the graduated social and health insurance contributions, as outlined in the German “gleitende Übergangbereich” system, which enables a gradual increase in contributions while maintaining corresponding social benefits.en
