| dc.description.abstract | Moje práce se zabývá institucí veřejného ochránce práv, která byla uzákoněna na základě zákona č.349/1999 Sb. o Veřejném ochránci práv. Veřejný ochránce práv (dále jen "ochránce") je poměrně novou institucí, která je českou modifikací světově rozšířené instituce ombudsmana. V kapitole první se zabývám vymezením instituce veřejného ochránce práv, jeho historického vzniku, ale i problematikou, proč není ochránce zakotven v Ústavě České republiky. Kapitola dvě charakterizuje ochráncovu volbu, nezávislost, mlčenlivost, trestní imunitu atd. Třetí kapitola se věnuje působnosti ochránce. Kapitola dále uvádí oprávnění, která ochránce získal na základě novelizací zákona. Zároveň zde vysvětluji vztah ochránce k Ústavnímu soudu. Čtvrtá kapitola je zaměřena na kontrolní činnosti ochránce. Jsou zde specifikovány nutné náležitosti podnětu, možnost jeho odložení, ale i průběh šetření a jeho výsledky. V poslední páté kapitole vysvětluji vztah ochránce a to jak k Poslanecké sněmovně, tak k Senátu. | cs |
| dc.description.abstract-translated | This thesis deals with the institution of the Public Defender of Rights which was established in the Act No. 349/1999 Coll., on the Public Defender of Rights. The Public Defender of Rights (hereinafter the "Defender") is a relatively new institution which can be considered as a Czech analogy to the world widespread institution of the Ombudsman. The first chapter includes definition of this institution, historical origin, and also the issue, why the institution of Defender is not established in the Constitution of the Czech Republic. The chapter two describes the Defender´s election, independence, confidentiality, criminal immunity etc. The third chapter informs about the mandate of the Defender. The chapter also enumerates authorizations which the Defender has obtained on the basis of amendments of the Act. Also, the relation between the Defender and the Constitutional Court of the Czech Republic is explained therein. The fourth chapter is targeted at control activity of the Defender. The necessary requisites of Complaint are specified here as well as the possibility of its suspension and the progress of the investigation processes and their results. The last chapter focuses on relation between the Defender and both the Chamber of Deputies and the Senate of the Czech Republic. | en |
