dc.description.abstractDezinformace a jiná nepravdivá sdělení jsou stále větší problémem dnešního světa především díky vlivu Internetu a sociálních sítí. Jsou hrozbou pro demokracii, bezpečnost a integritu informací, ale jsou nebezpečné i z lidskoprávní perspektivy. Účelem této diplomové práce je zkoumat a popsat vzájemný vztah mezi dezinformacemi a svobodou projevu chráněnou článkem 10 EÚLP. Hlavně se soustředím na předchozí rozsudky a rozhodnutí ESLP a to, co z nich vyplývá pro možné budoucí dezinformační případy. Odpovídám na otázku, zda jsou dezinformace chráněnou formou projevu podle 1. odstavce článku 10 a proč si myslím, že rozhodujícím faktorem pro jejich odmítnutí je zásada dobré víry a žurnalistická etika. Vysvětluji, jaké podmínky musí státy dodržet, pokud omezují lživé projevy v souladu s 2. odstavcem článku 10 a judikaturou ESLP. Dále se zaměřuji na článek 17, obsahující zákaz zneužití práva, jako možné potenciální řešení dezinformačního fenoménu. Na závěr se zabývám pozitivními povinnostmi, které pro státy vyplývají z článku 10, zejména právem na informace, a co se stane, pokud státy samy neříkají pravdu.cs
dc.description.abstract-translatedDisinformation and false narratives are an ever growing problem of today's world largely thanks to the Internet, social media and other modern technologies. They pose a threat to democracy, safety and integrity of information, but they are also a human rights issue. The aim of this thesis is to examine and describe the mutual relationship between disinformation and the right to free speech protected by the Article 10 of ECHR. It mainly focuses on previous judgements and decisions of ECtHR and what they imply regarding possible future disinformation cases. I answer the question, whether Article 10(1) guarantees the right to disinform with regard to the Court's distinction between facts and value judgments and why I think the good faith principle and journalistic ethics play a key role in rejecting disinformation as a protected expression. I explain what requirements must the member states fulfil, if they want to restrict untruthful expression in compliance with Article 10(2) and case-law of the ECtHR. I then take into consideration Article 17, the so-called Abuse Clause, as a possible solution to the disinformation phenomenon. In the end I analyse the positive obligation of a member states under Article 10, especially the right to information, and what happens when the states themselves aren't telling the truth.en
