Operacionální teorie práva

Abstract

Autor článku navrhuje koncepci vytvoření operační teorie práva, která je založena na lingvistické a právní analýze dat, tedy ucelených souborů právních dokumentů. Teorií v tomto smyslu rozumíme konceptuální strukturu, která vysvětluje data. Z dosavadních studií je zřejmé, že normativní koncepty klasické teorie práva nelze operacionalizovat. Východisko autor spatřuje v rozpoznávání atomických právních pojmů a vytváření sítí reprezentujících jejich vztahy. Teoretické pojmy jsou funkce fungující nad empirickou strukturou.

The author of the article proposes the concept of creating an operational theory of law, which is based on linguistic and legal analysis of data, i.e. complete sets of legal documents. By theory in this sense, we mean a conceptual structure that explicates data. It is clear from the studies to date that the normative concepts of classical theory of law cannot be operationalized. The author sees the starting point in recognizing atomic legal terms and creating networks representing their relations. Theoretical concepts are functions operating above an empirical structure.
