dc.description.abstractHlavním zaměřením diplomové práce je problematika trestného činu vraždy novorozeného dítěte matkou. Mimo úvodu a závěru, je práce rozdělena do dalších sedmi kapitol. Práce obsahuje historický exkurz právní úpravy tohoto trestného činu od druhé poloviny 19. století. Stěžejní část diplomové práce je věnována rozboru skutkové podstaty obsažené v ust. §142 zákona č. 40/2009 Sb., trestního zákoníku a problematice dokazování. Dále se práce zabývá trestní odpovědností pachatelky a sankcemi, které je pachatelce možné uložit. V diplomové práci není opomenuta ani kapitola věnující se komparaci naší právní úpravy se zahraniční úpravou.cs
dc.description.abstract-translatedThe main aim of this master thesis is the theme of the crime of the murder of a newborn child by his mother. Except for the introduction and conclusion, the thesis is divided into seven chapters. The thesis contains a historical excursion of the legal regulation of the murder of a newborn child by his mother since the second half of the 19th century. The main part of the thesis is devoted to the analysis constituent element of the new-born child murder committed by his mother and the issue of proving a crime. Besides other things, the thesis deals with the criminal responsibility of the offender and the sanctions that can be imposed on the offender. The diploma thesis does not omit the chapter devoted to comparison with foreign legislation.en
