dc.description.abstractDiplomová práce se věnuje problematice právní úpravy úmyslných umsrcení de lege lata. Trestný čin vraždy a trestný čin zabití představují v pojetí aktuálně platného českého trestního zákoníku nejzávažnější trestné činy směřující proti lidskému životu. Pro uvědomení si závažnosti předmětné problematiky a pochopení její podstaty je v diplomové práci vymezen lidský život, a to z hlediska narození a smrty coby dvou existenčních okamžiků. K tomu je uveden historický exkurs k vývoji právní úpravy úmyslných usmrcení na území českého státu. Těžištěm celé práce je podrobná analýza předmětných trestných činů, tj. trestného činu vraždy a trestného činu zabití, a to z hlediska vybraných trestněprávních aspektů. V neposlední řadě se v práci objevuje také zahraniční trestněprávní exkurs za účelem komparace s českou trestněprávní úpravou, závěrem pak úvahy de lege ferenda zaměřené na vybrané trestněprávní otázky.cs
dc.description.abstract-translatedThe diploma thesis deals with the issue of de lege lata regulation of intentional killings. The crime of murder and the crime of manslaughter represent the most serious crimes against human life in the current Czech Criminal Code. In order to realize the seriousness of the subject matter and to understand its essence, the thesis defines human life in terms of birth and death as two existential moments. In addition, a historical excursus is given on the development of the legal regulation of intentional killings in the territory of the Czech state. The focus of the whole work is a detailed analysis of the crimes in question, i.e. the crime of murder and the crime of manslaughter, in terms of selected criminal law aspects. Last but not least, the thesis also includes a foreign criminal law excursus for the purpose of comparison with the Czech criminal law, and finally de lege ferenda considerations focused on selected criminal law issues.en
