dc.description.abstractTéma této diplomové práce nese název "Trestněprávní a kriminalistické aspekty trestního řízení dětí a mládeže." Otázka mládeže a jejího delikventního chování je aktuálním problémem aktuální doby. Práce je členěna do odpovídajících kapitol a podkapitol. První kapitola pojednává o kriminalistických a trestněprávních aspektech trestní odpovědnosti dětí a mládeže. Pozornost je zaměřena na zvláštnosti věku a duševní zralost, historickou a současnou platnou úpravu a restorativní justici. Druhá kapitola pojednává o praktických aspektech trestního řízení, ve které jsou zohledněna specifika řízení. Třetí kapitola se zaměřuje na způsoby potrestání mládeže. Kapitola je prolnuta nahlédnutím do praxe nejčastěji ukládaných opatření. Čtvrtá kapitola se zaměřuje na kriminalitu mládeže, která je celospolečenským problémem. Je nežádoucí, avšak nikdy nevymizí. V kapitole je dále pojednáváno o jejích příčinách. Rozpracována je rovněž problematika prevence kriminality. Zohledněny jsou i kriminální statistiky Policie ČR Státního zastupitelství a Vězeňské služby. Pátá kapitola pojednává o komparaci české právní úpravy s vybranými úpravami cizích států. Šestá kapitola se zaměřuje na novodobé kauzy z vybraných soudních rozhodnutí.cs
dc.description.abstract-translatedThe topic of this master thesis is entitled "Criminal law and criminalistic aspects of criminal proceedings of children and youth." The issue of youth and their delinquent behaviour is a topical problem of the current times. The thesis is divided into appropriate chapters and subchapters. The first chapter deals with the criminalistic and criminal aspects of criminal responsibility of children and youth. Attention is focused on the peculiarities of age and mental maturity, the historical and current legislation in force and restorative justice. The second chapter deals with the practical aspects of criminal proceedings, in which the specifics of the proceedings are taken into account. The third chapter focuses on ways of punishing youth. The chapter is interspersed with insights into the practice of the most commonly imposed measures. The fourth chapter focuses on juvenile delinquency, which is a society-wide problem. It is undesirable, but it will never disappear. The chapter goes on to discuss its causes. The issue of crime prevention is also discussed. Crime statistics of the Police of the Czech Republic, the Public Prosecutor's Office and the Prison Service are also taken into account. The fifth chapter deals with the comparison of the Czech legislation with selected legislation of foreign countries. The sixth chapter focuses on modern cases from selected court decisions.en
