dc.description.abstractTato diplomová práce se zabývá problematikou smluvních typů upravující práva a povinnosti k softwaru a s nimi související aspekty. Vybranými dohodami jsou především smlouva o dílo a SaaS smlouva. Práce uvedené smlouvy rozebere v souvislosti s aktuální právní úpravou, analyzuje jejich obligatorní a fakultativní náležitosti a poskytne různá doporučení, jak koncipovat některé smluvní ujednání. Hlavním cílem této práce je analýza, kde je v této oblasti práva česká právní úprava dostatečná, a kde naopak by bylo vhodné ji změnit či doplnit.cs
dc.description.abstract-translatedThis thesis deals with the issue of contract types governing rights and obligations to software and related aspects. The selected agreements are mainly contract for work and the SaaS subscription. The thesis analyses these contracts in the context of the current legislation, analyses their obligatory and optional elements and provides various recommendations on how to draft certain contractual arrangements. The main objective of this thesis is to analyse where the Czech legal regulation is sufficient in this area of law and where, on the contrary, it would be advisable to change or supplement it.en
