K zamýšleným změnám trestního postihu tzv. drogových trestných činů

Abstract

Text se zabývá novelou trestního zákoníku a souvisejících právních předpisů, kterou dne 13. listopadu 2024 schválila vláda České republiky. Návrh zákona, předložený Poslanecké sněmovně, přináší zásadní změny v oblasti trestního práva, včetně snížení trestní represe, dekriminalizace některých jednání a zmírnění trestů za vybrané trestné činy, například zanedbání povinné výživy či podporu terorismu. Významné změny se týkají také recidivy majetkových trestných činů a právní úpravy drogových deliktů, přičemž nově umožňuje legální pěstování a držení konopí pro vlastní potřebu za stanovených podmínek. Návrh zavádí rozlišení mezi „zpracováním“ a „výrobou“ omamných látek a upravuje trestní postih za neoprávněné nakládání s nimi. Legislativní proces je v počáteční fázi a vláda usiluje o jeho schválení v aktuálním volebním období.

The text discusses the amendment to the Criminal Code and related legal provisions, which was approved by the Government of the Czech Republic on November 13, 2024. The bill, submitted to the Chamber of Deputies, introduces significant changes in criminal law, including the reduction of criminal repression, decriminalization of certain acts, and mitigation of penalties for selected offenses, such as failure to provide maintenance or support for terrorism. Notable changes also concern the recidivism of property crimes and the legal regulation of drug-related offenses, including the newly permitted legal cultivation and possession of cannabis for personal use under specific conditions. The proposal distinguishes between "processing" and "production" of narcotic substances and adjusts criminal liability for unauthorized handling of them. The legislative process is in its early stages, and the government aims to have the proposal approved within the current parliamentary term.
