dc.description.abstractCílem této diplomové práce je přinést nové poznatky z oblasti trestné činnosti v silniční dopravě a zaměřit se na jednání podvodného charakteru v silniční dopravě. Práce je věnována třem trestným činům, kterými jsou manipulace s tachografem, manipulace s počítadlem ujeté vzdálenosti a pojistný podvod. Všechny tři trestné činy spojuje jejich podvodný charakter a zejména rozmanitost jednání pachatelů, jakým k těmto trestným činům dochází. Práce se věnuje způsobům spáchání jednotlivých trestných činů a u prvních dvou zmíněných za jakých okolností je takové jednání možno postihnout prostředky trestního práva a kdy se jedná pouze o přestupek, jelikož se jedná o záležitost značně problematickou. U jednotlivých trestných činů jsou rozebrány jejich skutkové podstaty a vše je podloženo příklady z judikatury. V neposlední řadě je v práci úvaha de lege ferenda, kde jsou formulována možná řešení úpravy této problematiky.cs
dc.description.abstract-translatedThe aim of this diploma thesis is to bring new knowledge in the field of criminal activity in road transport and to focus on acts of a fraudulent nature in road transport. The work is dedicated to three crimes, which are manipulation of the tachograph, manipulation of the distance meter and insurance fraud. All three crimes are connected by their fraudulent nature and, in particular, the variety of actions of the perpetrators, in which these crimes occur. The work is dedicated to the ways of committing individual crimes and, in the first two mentioned, under what circumstances such behavior can be punished by criminal law and when it is only a misdemeanor, since this is a very problematic matter. For individual crimes, their factual nature is analyzed and everything is supported by examples from case law. Last but not least, the work contains a consideration de lege ferenda, where possible solutions for regulating this issue are formulated.en
