dc.description.abstractDiplomová práce se zabývá trestným činem opilství dle § 360 trestního zákoníku. Na počátku práce jsou pro lepší pochopení zmíněny základní pojmy související s uvedeným trestným činem a historický kontext. Dále je objasněna skutková podstata trestného činu opilství a není opomenuta ani problematika actio libera in causa culposa a dolosa. Zmíněny jsou i trestní sankce ukládané za trestný čin opilství. Podrobněji je však rozpracována kapitola dokazování, která zahrnuje zjišťování přítomnosti alkoholu a jiných návykových látek v lidském těle, toxikologické vyšetření a znalecký posudek z oboru psychiatrie. V závěru práce je uveden rozbor dvou rozhodnutí soudu a srovnání trestného činu opilství se zahraničními právními řády. Cílem práce je objasnit trestný čin opilství srozumitelným způsobem, zhodnotit jeho právní úpravu a uvést návrhy de lege ferenda.cs
dc.description.abstract-translatedThe diploma thesis deals with the crime of drunkenness according to § 360 of the Criminal Code. At the beginning of the work, for a better understanding, the basic terms related to the mentioned crime and the historical context are mentioned. Furthermore, the factual nature of the crime of drunkenness is clarified, and the issue of actio libera in causa culposa and dolosa is not neglected either. Criminal sanctions imposed for the crime of drunkenness are also mentioned. However, the evidence chapter is elaborated in more detail, which includes detection of the presence of alcohol and other addictive substances in the human body, toxicological examination and expert opinion from the field of psychiatry. At the end of the thesis, there is an analysis of two court decisions and a comparison of the crime of drunkenness with foreign legal systems. The aim of the work is to clarify the criminal act of drunkenness in an understandable way, to evaluate its legal regulation and to present proposals de lege ferenda.en
