dc.description.abstract	Tématem předkládané práce je problematika odpovědnosti za škody způsobené emisemi a exhalacemi. V úvodu práce dochází k definování a objasnění základních pojmů, které na předmětnou problematiku navazují. Po stručném historickém exkursu následuje zařazení škody způsobené emisemi a exhalacemi v systému náhrady škody v českém právním řádu, přičemž je věnována pozornost pramenům předmětné právní úpravy, lhůtám pro uplatnění nároku a institutu liberace. Práce se věnuje taktéž otázce aktivní a pasivní legitimace k náhradě škody způsobené emisemi a exhalacemi. V neposlední řadě je prací pojednáváno o roli a úloze soudního znalce při zjišťování příčinné souvislosti mezi jednáním a následkem - škodou způsobenou emisemi a exhalacemi. V závěru práce je předestírána právní úprava předmětné problematiky ve Spolkové republice Německo a uvedení návrhu de lege ferenda.	cs
dc.description.abstract-translated	The topic of the presented work is the issue of liability for damages caused by emissions and exhalations. In the introduction, there is a definition and clarification of basic concepts that relate to the issue. A brief historical excursion is followed by the inclusion of damage caused by emissions and exhalations in the system of compensation in the Czech legal system, while attention is paid to the sources of the legislation, deadlines for claiming and the institute of liberation. The thesis also deals with the issue of active and passive legitimacy to compensate for damage caused by emissions and exhalations. Last but not least, the work deals with the role of a forensic expert in determining the causal link between the conduct and the consequence - the damage caused by emissions and exhalations. At the end of the thesis, the legal regulation of the subject matter in the Federal Republic of Germany and the presentation of the proposal de lege ferenda is presented.	en
