dc.description.abstractDiplomová práce "Postavení manžela povinného v exekučním řízení" je rozdělena do šesti kapitol. Úvodní kapitola nastíní čtenáři záměr této práce. Druhá kapitola se věnuje hmotnému právu, konkrétně společnému jmění manželů, dluhům a odpovědnosti za ně. Ve třetí kapitole se úvodem věnuji základní charakteristice exekučního řízení, dále definuji účastníky řízení a způsoby provedení exekuce ve vztahu k manželi povinného. Čtvrtá kapitola je zaměřená na prostředky obrany manžela povinného. V poslední kapitole se zaměřuji na komparaci se státem Německo. V závěru jsou shrnuty poznatky a mé názory na dané téma.cs
dc.description.abstract-translatedThe thesis "Status of Obliged Persons's Spouse in the Distrainment" is divided into six chapters. The first chapter introduces the reader to the issue of distraint and gives the reader information on the intentions of this work. The second chapter deals with subtantive law, namely the joint property of spouses, debts and responsibilty for them. In the third chapter I give an introuction to the basic characteristics of execution proceedings, further define the parties to the proceedings and the ways of executio in relation to the spouse. The fourth chapter focuses on the means of defending the obligor's husband. In the last chapter I focus on comparison with the state of Germany. The conclusion summarizes the findings and my opinions on the topic.en
