dc.description.abstractDiplomová práce se zabývá tématem identifikace osob jako důkazního prostředku v trestním řízení. Spojuje tedy k sobě dva velmi si blízké vědní obory, a to kriminalistiku a trestní právo. Cílem práce je primárně systematicky popsat důležitost a využitelnost metod identifikace osob jako důkazního prostředku užívaného v trestním řízení. Dalším cílem je poukázat na přístup odborníků a soudů v judikatuře k některých metodám identifikace osob v kontextu práva na spravedlivý proces, především na získávání, využívání a uchovávání dat získaných z takových metod. Práce se skládá z pěti částí. Nejprve autor popisuje samotný proces dokazování jako důležitý prvek celého trestního řízení. Zde autor vymezuje základní zásady dokazování, definuje základní pojmy dokazování a popisuje průběh dokazování. Ve druhé kapitole se autor zabývá znaleckou činností jako nepostradatelnou činností při identifikaci osob, zároveň zde autor vymezuje osobu znalce. V samostatné kapitole se autor následně zabývá kriminalistikou jako vědním oborem, kriminalistickou identifikací jako obecným pojmem a jednotlivými metodami identifikace osob. Do samostatné čtvrté kapitoly je pak zařazen obecný popis identifikace osob v trestním řízení - zde se autor věnuje ohledání (zejména místa činu) a kriminalistické expertize. V poslední kapitole se autor zaměřuje na identifikaci osob v kontextu práva na spravedlivý proces a poukazuje na současný přístup soudů k této identifikaci jakožto důkazu v trestním řízení s odkazem na konkrétní judikaturu vnitrostátních i mezinárodních soudů.cs
dc.description.abstract-translatedThe thesis deals with the topic of identification of persons as evidence in criminal proceedings. It brings together two very close disciplines, namely criminalistics and criminal law. The aim of the thesis is primarily to systematically describe the importance and applicability of methods of identification of persons as a means of evidence used in criminal proceedings. Another aim is to highlight the approach of experts and courts in case law to certain methods of identification of persons in the context of the right to a fair trial, in particular the acquisition, use and storage of data obtained from such methods. The thesis consists of five parts. First, the author describes the process of evidence itself as an important element of the entire criminal procedure. Here the author defines the basic principles of evidence, defines the basic concepts of evidence and describes the course of evidence. In the second chapter, the author deals with the expert activity as an indispensable activity in the identification of persons, while at the same time the author defines the person of the expert. In a separate chapter, the author then deals with criminalistics as a scientific discipline, criminal identification as a general concept and individual methods of identification of persons. A separate fourth chapter includes a general description of identification of persons in criminal proceedings - here the author discusses examination (especially of crime scenes) and criminalistic expertise. In the last chapter, the author focuses on the identification of persons in the context of the right to a fair trial and highlights the current approach of the courts to such identification as evidence in criminal proceedings, with reference to specific case law of national and international courts.en
