dc.description.abstractTato diplomová práce se věnuje tématu řízení o pozůstalosti se zaměřením na likvidaci pozůstalosti. Hlavním cílem diplomové práce je podat ucelený pohled na výklad řízení o pozůstalosti a podrobně popsat proces likvidace pozůstalosti. Práce je členěna do čtyř hlavních kapitol a dále obsahuje úvod, závěr a cizojazyčné resumé. První kapitola se věnuje popisu hmotněprávních institutů dědického práva. Následuje kapitola, která popisuje řízení o pozůstalosti a jeho jednotlivé fáze. Třetí kapitola pojednává o postupu likvidace pozůstalosti, především o tom, kdy k likvidaci dochází a za jakých podmínek. Poslední kapitola je věnována stručné komparaci řízení o pozůstalosti s právní úpravou Francouzské republiky, jejíž cílem je poukázat na rozdíly a shody v cizí právní úpravě.cs
dc.description.abstract-translatedThis master thesis deals with the topic of estate proceedings with a focus on the liquidation of the estate. The main objective of the thesis is to provide a comprehensive view of the interpretation of the estate proceedings and to describe in detail the process of liquidation of the estate. The thesis is divided into four main chapters, and apart from them, it also includes an introduction, conclusion, and a foreign language summary. The first chapter is devoted to a description of the substantive institutes of the law of succession. It is followed by a chapter describing the proceedings on the estate and its various stages. The third chapter deals with the procedure of liquidation of the estate, in particular when liquidation takes place and under what conditions. The last chapter is devoted to a brief comparison of the succession procedure with the French legislation, which aims to highlight the differences and similarities in the foreign legislation.en
