dc.description.abstractTato diplomová práce pojednává o věcných právech v občanském zákoníku. Stručně je věnován prostor historickému vývoji věcných práv. Věcná práva jsou vymezena a charakterizována dle svých společných vlastností a odlišena od práv závazkových s tím, že je upozorněno na to, že hranice mezi věcnými právy a právy závazkovými není ostrá. S ohledem na numerus clausus věcných práv jsou v této práci charakterizovány všechny instituty věcných práv v občanském zákoníku. Ke konci práce je pojednáváno o společných a rozdílných rysech institutu držby a vlastnického práva v jiných právních řádech a to se zaměřením na Spolkovou republiku Německo a Rakouskou republiku.cs
dc.description.abstract-translatedThis diploma thesis deals with rights in rem in the Civil Code. The beginning of the thesis is devoted to the historical development of rights in rem. Rights in rem are defined, characterised by their common characteristics, and they are differentiated from the rights in obligation with an emphasis on the fact that the line between rights in rem and rights in obligation is not sharp. In this thesis are presented all of the institutes of rights in rem in the Civil Code with regard to its numerus clausus. At the conclusion of the thesis, I deal with common and different characteristics of the institute of possession and right of superficies in other legal systems with a focus on the Federal Republic of Germany and the Republic of Austria.en
