dc.description.abstractTato diplomová práce se zabývá problematikou práva jednotlivce znát svůj genetický původ. Cílem této diplomové práce je analyzovat právní aspekty práva jednotlivce znát svůj genetický původ a zamyslet se nad tím, zda je toto právo dostatečně zajištěno v právním řádu České republiky. První kapitola se zabývá pojmem genetický původ, jak z obecného hlediska, tak z hlediska právního. Druhá kapitola obsahuje výčet osobnostních práv jednotlivce a dítěte, pod které právo znát svůj původ zapadá. Třetí kapitola shrnuje základní mezinárodní dokumenty, které se práva jednotlivce znát svůj genetický původ týkají. Čtvrtá kapitola se týká nejvýznamnějšího pramene v oblasti práv dítěte - Úmluvy o právech dítěte. Pátá kapitola se věnuje určování rodičovství, kde se zaměřuji na porovnání právních domněnek otcovství s právem jednotlivce znát svůj genetický původ. Šestá kapitola přibližuje problematiku osvojení a jeho kontrast s právem dítěte znát svůj genetický původ. Sedmá kapitola se zabývá asistovanou reprodukcí, se speciálním zaměřením na přísnou anonymitu dárcovství a soustředí se také na náhradní mateřství. Oba instituty porovnávám s právem jednotlivce znát svůj genetický původ. Osmá kapitola je zaměřená na anonymní porody, porody s utajenou totožností matky a na diskrétní porody. V této kapitole přibližuji problematickou právní úpravu porodu s utajenou totožností matky a zaměřuji se na jeho kolizi s právem jednotlivce znát svůj genetický původ. Devátá kapitola je věnována baby-boxům a porovnání s právem jednotlivce znát svůj genetický původ. Desátá kapitola se věnuje judikatuře ESLP a českých soudů, která se přímo dotýká práva znát svůj původ.cs
dc.description.abstract-translatedThis diploma thesis deals with the issue of the individual's right to know his genetic origin. The aim of this diploma thesis is to analyze the legal aspects of the individual's right to know their genetic origin and to consider whether this right is sufficiently ensured in the legal system of the Czech Republic. The first chapter deals with the concept of genetic origin, both from a general perspective and from a legal perspective. The second chapter includes a list of the individual and the child personality rights, under which the right to know one's origin falls. The third chapter summarizes the fundamental international documents related to to the individual's right to know his genetic origin. The fourth chapter refers to the most significant source in the field of children's rights - Convention on the Rights of the Child. The fifth chapter is devoted to the determination of parentage, where I focus on comparing the legal presumptions of paternity with the individual's right to know his genetic origin. The sixth chapter presents the issue of adoption and its contrast with individual's right to know his genetic origin. The seventh chapter deals with assisted reproduction, with a special focus on the strict anonymity in donation and it also focuses on surrogacy. I compare both institutes with the right of an individual to know his genetic origin. The eighth chapter is focused on anonymous births, births with concealed identity of the mother, and discreet births. In this chapter, I approach the problematic legal regulation of births with a concealed identity of the mother and focus on its collision with the individual's right to know his genetic origin. The ninth chapter is devoted to baby boxes and comparisons with the right of the individual to know his genetic origin. The tenth chapter focuses on the jurisprudence of the European Court of Human Rights and Czech courts, which directly affects the right to know one's origin.en
