Převádění státního zaměstnance na jiné služební místo

Abstract

Článek se zabývá problematikou převádění státního zaměstnance na jiné služební místo podle § 61 zákona o státní službě. Převedení na jiné služební místo představuje změnu služebního poměru, která je způsobilá významným způsobem ovlivnit právní postavení státního zaměstnance. Státní zaměstnanec může být převeden na jiné služební místo, pokud z různých důvodů nemůže vykonávat službu na stávajícím služebním místě, např. ze zdravotních důvodů, z důvodů organizačních změn či z důvodu nedostatku požadované kvalifikace či jiných předpokladů. Článek se zaměřuje na důvody převedení a na kritéria, která musí být zohledněna při výběru nového služebního místa, stejně tak na způsoby obrany státního zaměstnance proti rozhodnutí o převedení.

The paper deals with the issue of transfer of civil servants to another service post according to section 61 of Civil Service Act. Transfer to another service post represents a change of the service relationship and can significantly impact the legal status of the civil servant. A civil servant may be transferred when they are unable to perform their duties in their current position due to various reasons, such as health issues, organizational changes, or a lack of required qualifications or another prerequisities. The paper focuses on the reasons for transferring civil servants to another post and the criteria that should be considered when choosing the new position, as well as on the ways of defence against the transfer decision.
