dc.description.abstractTato práce je zaměřena na zvláštní formy přezkumného řízení, přičemž institut přezkumného řízení jako dozorčí prostředek sloužící k nápravě nezákonných pravomocných rozhodnutí nabývá dle správního řádu různých podob v závislosti na tom, co je předmětem přezkumu. Cílem této práce je analýza aktuální právní úpravy a relevantních dostupných zdrojů a následné posouzení a pokus o ucelení problematické subsidiární aplikace obecných ustanovení. Sekundárním cílem je dále zhodnocení, zda aktuální právní úprava vykazuje mezery a zda je prostor pro jejich případné vyplnění. Autor práce cíle úspěšně naplňuje.cs
dc.description.abstract-translatedThis master thesis focuses special forms of review procedure which is used for change or cancelation unlawful administrative acts. Main aim of this thesis is to analyze current legislation. Secondary goals are to reveal, if there are any problems in use of general provisions in special forms, which regulate the issue of making and releasing acts by administrative offices. Furthermore, the goal is also evaluation if current legislation is sufficient and whether it shows any deficiencies. Body of this thesis mainly consist of base regulation of review procedure, which is important for following chapters, because special forms often use primary rules for handeling the review procedure. Chapters are divided by reviewed acts and gradually describe and compare differences between base form and special forms. The end of the thesis is briefly dedicated to other special forms of review procedure which are contained in other laws than Code of Administrative procedures. Last chapter closes the whole thesis with suggested solutions of problems, that were found during the analysis of base and special forms of review procedure.en
