| dc.description.abstract | Diplomová práce se zabývá problematikou bezdůvodného obohacení z pohledu soudní judikatury. Úvodem představuje institut bezdůvodného obohacení a jeho historický vývoj, následně popisuje problematiku bezdůvodného obohacení v současné právní úpravě a porovnává ji s úpravou předchozí. Ve druhé části se zaobírá problematikou generální klauzule a vybraných skutkových podstat bezdůvodného obohacení, třetí část vymezuje rozsah restituční povinnosti a okolností, které její rozsah ovlivňují. Závěrečná část se věnuje tématu promlčení bezdůvodného obohacení. | cs |

The introduction is primarily focused on the institute of unjust enrichment and its historical development, furthermore, it describes the issue of unjust enrichment in the current legal regulation and compares it with the previous regulation. The second part of the thesis is focused on the issue of the general clause and selected facts of unjust enrichment. The third part of the thesis defines the scope of the restitution obligation and the circumstances that affect its scope.
