dc.description.abstractDiplomová práce je koncipována jako trestněprávní rozbor problematiky vývojových stadií trestného činu v českém trestním právu. Zpočátku se zaobírá historickým vývojem institutů, jež se pojí s vývojovými stadii trestného činu, aby pak v následujících dílčích kapitolách rozebrala jednotlivá stadia trestného činu se všemi jeho specifickými charakteristikami. Veliký důraz je kladen na diferenciaci institutů vývojových stadií trestného činu z pohledu minulé trestněprávní nauky a té současné. Vedle páteřních kapitol se rovněž zaměřuje i na dohodu o vině a trestu, která má pro vývojová stadia trestného činu zásadní význam. Ke konci nabízí práce zhodnocení institutů vývojových stadií trestného činu z pohledu de lege ferenda, resp. umožňuje srovnání české právní úpravy s německou. V samotném závěru se vyskytují alternativní řešení dané problematiky, resp. možné návrhy nových zákonných dikcí ustanovení, jež se pojí se zadaným tématem.cs
dc.description.abstract-translatedThis master´s thesis is conceived as the criminal analysis of the development stages of the criminal offence in Czech criminal law, in which it distinguishes three development stages. These are the preparation of the criminal offence, the attempted criminal offence and the accomplished criminal offence. The master´s thesis begins with the historical development, while the chapters deal with particular development stages and their own specifics. Great emphasis is placed on differentiation of the institutes from the perspective of past and present criminal science. Beside the main chapters it also focuses on the agreement on guilt and punishment. This new penal institute is a breakthrough in the field of the development stages of the criminal offence. At the end, the master´s thesis offers an evaluation de lege ferenda, or more precisely it allows to compare German law with the Czech one. At the very end there are presented some alternative solutions and proposals of new legal sections connected with the development stages of the criminal offence.en
