dc.description.abstractRigorózní práce je věnována institutu nálezu a právu na nálezné se zaměřením na nález věci. V práci jsou nejdříve rozebrány pojmy ve vztahu k tématu práce podstatné; poté je provedena analýza právních rozdílů v povaze jednotlivých nalezených věcí. Tato úvodní kapitola je následována rozborem věnujícím se historii institutu nálezu a práva na nálezné, aktuální právní úpravou a trestněprávními důsledky v případě, kdy by nebyl nález řádně oznámen. Jelikož mohou mít nálezy a s tím související právo na nálezné i mezinárodní dopady, jsou kapitoly šestá a sedmá věnovány tzv. Benešovým dekretům, mezinárodnímu právo a právu Evropské unie. V předposlední kapitole jsou nastíněny případy uskutečněných nálezů a jak v těchto případech státní orgány ve vztahu k náleznému postupovaly a jeden doposud neuskutečněný, avšak neméně zajímavému, případ tzv. štěchovickému pokladu. Závěrečná část rigorózní práce pak rozebírá možnosti soukromoprávní dispozitivnosti a smluvní volnosti ve věci nálezu a práva na nálezné.cs
dc.description.abstract-translatedThis rigorous thesis is devoted to a concept of discovery and discoverer's reward with a focus on discovery of a thing. The thesis opens with definitions of relevant concepts. Subsequently, I examined legal differences between individual discoveries, since the very nature of a discovery plays a significant role when determining which legislation should govern the following proceedings regarding the discoverer and the discoverer's reward. The following chapter maps out the evolution of our approaches towards discoveries, reward claims or methods of determining ownership rights, followed by an analysis of our current legal understanding of a discovery and repercussions of failing to duly report a discovery. As there are more international regulations to be considered, sixth and seventh chapter are addressed to the post-war Decrees of the President of the Republic, the so-called Beneš decrees, international treaties, or the legislation of the European Union. Next chapter consists of two parts, the first part covers real discoveries that occurred in the past and the way how authorities have proceeded them differently, and the second part focuses on a potential discovery - the so-called Štěchovice treasure. The ninth, and final, chapter examines the default rules of private law and the amount of stakeholders' autonomy when it comes to discoveries and the discoverer's reward.en
