The relationship between International and National Law

Abstract

The relationship between international and domestic law is subject to doctrinal and often dogmatic disputes. However, there have been modern changes to this relationship in international law. International law is no longer jus inter potestates, and national implementation of international law has assumed paramount importance. This article tries to briefly describe the various approaches of some countries, especially EU members, including the Czech Republic, to international law. In general, however, states have an obligation to act in accordance with international law.

Vztah mezi mezinárodním a vnitrostátním právem je předměten doktrinálních a často dogmatických sporů. V mezinárodním právu však došlo k moderním změnám tohoto vztahu. Mezinárodní právo již není jus inter potestates a vnitrostátní implementace mezinárodního práva nabyla mimořádné důležitosti. Tento článek se snaží v krátkosti popsat různé přísetupy některých zemí, zejména členů EU, včetně České republiky, k mezinárodnímu právu. Obecně mají ovšem státy povinnost jednat v souladu s mezinárodním právem.
