| dc.description.abstract | Tato diplomová práce se zabývá problematikou náhrady nákladů civilního soudního řízení. Jedná se o specifickou oblast občanského práva procesního, která je odbornou veřejností stále vnímána okrajově. Přitom je třeba mít na paměti, že rozhodování o nákladech řízení je neodmyslitelnou součástí téměř každého rozhodnutí, ať už meritorního či nemeritorního. O tom, že institut nákladů řízení je jako takový soudy podceňován, svědčí i nejednotná rozhodovací praxe soudů, k jejímuž sjednocování přispívá zejména Ústavní soud České republiky ve svých judikaturních rozhodnutích. Účelem této práce je proto uvést čtenáře do základů problematiky náhrady nákladů řízení a poukázat na některá úskalí, která s sebou dané téma přináší, jakož i na důležitost samotného institutu nákladů řízení zasluhující patřičnou pozornost. | cs |
| dc.description.abstract-translated | This diploma thesis deals with the issue of the reimbursement of the costs of civil court proceedings. It is a specific field of civil procedural law still viewed as marginal by the professional community. At the same time, however, it should be borne in mind that decisionmaking on the costs of proceedings represents an integral part of almost every decision, whether substantive or non-substantive. The fact that the institute of the costs of proceedings as such tends to be underestimated by courts is demonstrated by the non-uniform decisionmaking practice of courts, the unification of which is especially contributed to by the Constitutional Court of the Czech Republic in its case-law decisions. The purpose of this thesis, therefore, is to provide an introduction to the basics of the reimbursement of the costs of proceedings and to point out some pitfalls entailed in this issue as well as the importance of the institute of the reimbursement of the costs of proceedings, which deserves due attention. | en |
