| dc.description.abstract | Tato práce se zabývá způsobem a rozsahem náhrady nemajetkové újmy při ublížení na zdraví a usmrcení. Cílem této práce je zejména poskytnout přehled současné občanskoprávní úpravy a rovněž stručný historický vývoj náhrady nemajetkové újmy vzniklé v důsledku ublížení na zdraví a usmrcení. Velká pozornost je v práci věnována Metodice NS, podle které se stanovuje náhrada za bolest a ztížení společenského uplatnění. Úvodní kapitola se obecně věnuje pojetí nemajetkové újmy, vzniku povinnosti k její náhradě, způsobu náhrady a také funkcím náhrady nemajetkové újmy. Druhá kapitola se konkrétně zabývá nemajetkovou újmou při ublížení na zdraví. Další tři kapitoly rozebírají jednotlivé složky náhrady nemajetkové újmy, kterými jsou bolestné, ztížení společenského uplatnění a další nemajetkové újmy. Šestá kapitola je věnována náhradě tzv. sekundárním obětem, ke které dochází při usmrcení člověka. Sedmá kapitola pojednává o tzv. malé generální klauzuli nemajetkové újmy, která je speciálním případem, kdy zákon stanovuje povinnost nahradit nemajetkovou újmu. Osmá kapitola přináší stručný přehled nejzásadnějších majetkových újem, které vznikají v souvislosti se zásahem do života či zdraví. Poslední kapitola, představuje exkurz do pracovního práva v oblasti nemajetkové újmy při ublížení na zdraví a usmrcení. | cs |
| dc.description.abstract-translated | This thesis focuses on Method and extent of compensation for non - material damage in the event of health injury and death. The aim of this work is to try to explain a civil legislation of a compensation for for non - material damage in the event of health injury and death and also to summarize a history of the civil legislation. An extensive attention in the thesis is given to Metodika NS, because it is a crucial document for setting an equitable compensation for non - material damage in the event of health injury and death. In the first part of the thesis there is a definition of material and non - material damage. After that, there is an explanation of a general compensation for non - material damage. The second chapter describes non-material damage in the event of health injury and parts of compensation are also stated. Three following chapters study a compensation for pain, a compensation for non-material damage, which is a a compensation for difficulty in social application, and other non-material damages. The following chapter describes a compentsation for non - material damage in the event of death. The next chapter describes a small general clause of non-material damage. The eight chapter describes the material damage, which originates from damage in the event of health injury. The last chapter brings a general overview of legislation in labor work, where non-material damage in the event of health injury and death is described. | en |
