Meze zneužívání práva na informace

Abstract

Tento článek se zabývá problematikou poskytování informací podle zákona č. 106/1999 Sb., o svobodném přístupu k informacím a s ním souvisejícího zneužívání práva na informace. Je popsán princip zákazu zneužívání práva na informace. S použitím judikatury vysokých soudů je ukázán jejich postup vymezení zneužívání práva na informace, jako důvodu pro odmítnutí práva na informace. Dále je nastíněn postup povinného subjektu v případě zneužití práva na informace. Rovněž je zmíněn postup žadatelů, jak se mohou proti postupu povinného subjektu bránit.

This article addresses the issue of providing information under Act No. 106/1999 Coll., on the right to access information, and the related abuse of this right. It describes the principle of prohibiting the abuse of the right to information. Using the case law of the high courts shows their approach to defining the abuse of the right to information as a reason for refusing the right to information. It also outlines the procedure to be followed by the obligated entity in the event of abuse of the right to information. It also mentions the procedure for applicants to defend themselves against the actions of the obligated entity.
